The following terms and conditions are the terms on which Tolley Badges Ltd (“the Company”) sells products and supersedes all other terms and conditions relating to those products.
IMPORTANT NOTES / TERMS & CONDITIONS, PLEASE ENSURE YOU HAVE READ & UNDERSTOOD.
No order can be accepted unless you have received a written quotation from us prior to ordering although this is down to the company’s discretion as verbal quotes and orders may be taken over the phone.
Orders can only be accepted from persons 18 years or over.
*Orders can only be invoiced to the person who submits the order and they are responsible for payment. We may invoice to a third party if they give us their written consent. If a third parties name is submitted without this consent being given it will be disregarded and the goods will be invoiced to the person who orders.
DEPOSITS. Non account customers may be asked for either a 50% deposit, or full payment with order. Your order will not be processed until this is received. If, for any reason whatsoever, your order is cancelled; this payment is strictly non-returnable.
SCOUT & GUIDE LOGOS. Designs featuring the Scout “fleur-de-lys” or Girlguiding “trefoil” logos can only be accepted if ordered by a bona fide Scout or Girlguiding member.
ARTWORK. Finished artwork based on your submitted design/design brief will be sent before production. PRODUCTION WILL NOT COMMENCE UNTIL WE HAVE RECEIVED APPROVAL OF ARTWORK. Please note that we do not make any additional charges for artwork and origination based on your original design/description submitted with your order - this is all included in our quoted prices. However, once our finished artwork has been submitted to you, based on the instructions given by you at the time of ordering (on our order form or on your artwork), should you wish to make any major alterations or changes, then a subsidised charge of £30 plus VAT will be levied for additional graphics work and time involved. Obviously, if we have made a mistake then the artwork will be amended free of charge, this is why you must carefully check the finished artwork for any mistakes, we cannot be held responsible for any mistakes after you have approved. Any additional charges will be added to your final invoice unless a request for payment is made by ourselves in advance. The designers will be happy to make up to three minor changes to your artwork free of charge if you so wish. This is subject to the designer’s discretion. All repeat orders will be based on previous patterns so no artwork will be forwarded.
ARTWORK APPROVAL. Once artwork has been approved by the customer, Tolley Badges Ltd accepts no responsibility for errors including spelling, grammar, punctuation, layout, sizing, colours (unless Pantone matched), dimensions or omissions contained within the approved artwork.
AI Opt-Out
The use of AI-assisted software forms part of Tolley Badges Ltd's standard workflow. If you do not wish your submitted artwork, logos, sketches, photographs or design concepts to be used within our AI-assisted design process, you must notify us in writing by replying to your Order Acknowledgement email before artwork production commences.
Where an opt-out request is received before artwork production begins, your design will be completed entirely using our traditional in-house design process. Please note that this may increase artwork preparation times and, in some cases, additional artwork charges may apply if significantly more design time is required. Once artwork production has commenced, we may be unable to accept an opt-out request.
COLOUR MATCHING. If your bespoke design requires any specific colours, please provide Pantone references, physical samples or colour swatches. Colours will be matched as closely as manufacturing processes allow, but slight variations may occur due to the manufacturing process and the differences between digital displays and physical products.
If colour accuracy is critical, we strongly recommend requesting a pre-production sample for approval before manufacture commences. This will add approximately two weeks to the delivery time but will allow colour (not design) amendments to be made before full production.
Please note that images viewed on computer monitors, mobile devices or supplied by email may not accurately represent the final manufactured colours.
Where the customer does not provide Pantone references, physical samples or colour swatches, and chooses not to request a pre-production sample, Tolley Badges Ltd will manufacture the order using colours matched as closely as reasonably possible. In these circumstances, Tolley Badges Ltd cannot accept responsibility for colour variations and will not be liable for the cost of remanufacture, replacement or refund where the finished colours differ from the customer's expectations.
DST Files: If you request the DST file of your completed design for other products, we make the following charge:
Up to 3” (75mm) - £25.00 + VAT, up to 4½” (115mm) - £35.00 + VAT, Larger sizes – prices available on request. Please note: we do not guarantee that DST files will be compatible with other supplier/manufacturers machines and therefore no refunds will be offered.
ADAPT-A-BADGE: Please ensure that you have thoroughly checked your wording (including spelling, spaces and punctuation) when ordering from our personalised, template range. Tolley Badges Ltd will not be responsible for any errors made by the customer when submitting the wording on our order form. The wording submitted will be assumed to be correct and will be reproduced exactly as entered on the order form. All lettering will be reproduced in upper case.
Orders will not proceed into production until full payment has been received.
DELIVERY TIMES. Please note that delivery times vary on a day-to-day basis and are very much subject to seasonal fluctuation. For this reason the approximate delivery times stated on your quotation may have changed by the time you order. If your order is subject to a deadline date requirement this must be stated on your order. If a date is not stated on your order, we cannot guarantee a delivery date and the delivery time will be at the current lead time, which may vary on a day-to-day basis. Deadline dates sooner than our quoted delivery times can only be accepted by prior arrangement. Please telephone before placing your order.
METHOD OF DESPATCH. A signature / proof of dispatch will be obtained by ourselves at the point of dispatch of your order, we are not responsible for your order beyond this point. Any correspondence or claims relating to late or non-delivery of your order must be made directly with the couriers and not with ourselves. Recorded delivery and consignment numbers can be obtained by phone from ourselves. Small orders are always despatched by Yodel Economy Delivery and larger orders by other couriers, on a Next Day Delivery service, by both methods a signature will always be required on delivery and if it is likely that no one will be available at your address to accept parcels, you may wish to let us have an alternative address – this must be stated on your order as it may not be possible to change after you have received an order acknowledgment.
MARKETING, PORTFOLIO & SOCIAL MEDIA. Unless otherwise agreed in writing prior to production, Tolley Badges Ltd reserves the right to photograph, scan, digitally reproduce or otherwise display completed products, finished artwork or production samples for the purposes of promoting our business. This may include use on our website, social media platforms, printed brochures, catalogues, exhibitions, trade publications, advertising, marketing materials and other promotional media.
We will not intentionally publish personal information or confidential customer details alongside any images without permission. Where practical, names, contact details or other identifying information will be removed or obscured.
If your order contains confidential information, has not yet been publicly launched, relates to a security-sensitive organisation, or you otherwise do not wish your products or artwork to be featured in our marketing, you must notify us in writing by replying to your Order Acknowledgement email before production commences. Upon receipt of such notification, Tolley Badges Ltd will not use your order for promotional or marketing purposes.
This clause applies only to the display of the completed product or artwork for promotional purposes and does not affect the ownership of any intellectual property rights, which remain subject to the Copyright provisions contained within these Terms and Conditions.
QUANTITIES. As mentioned in our literature, although we will endeavour to supply the exact quantity ordered, due to the manufacturing processes involved in a bespoke item, it is often difficult to produce an exact quantity. In common with trade practice, we reserve the right to supply plus or minus 5% of the quantity ordered. Only the quantity supplied will be charged.
YOUR RIGHT TO CANCEL.
Select-a-Badge (off the shelf) products you have the legal right to cancel your order within 7 working days. Orders that are cancelled and returned through no fault of Tolley Badges Limited will be subject to a 10% administration charge which will automatically be deducted from any refund due. All return shipping/postage costs are the responsibility of the customer.
YOUR RIGHT TO CANCEL ITEMS MADE TO YOUR SPECIFICATION (NON-STOCK ITEMS)
Items that have been specially made, personalised or customised specifically for you, or if you have made a spelling mistake/omission on your personalised product, or whereby a product is personalised in any form (Design-a-Badge or Adapt-a-Badge products) are not subject to the 7 working days’ rule. A change of mind, or error on the customer’s behalf, is not a right to cancel.
Adapt-a-Badge: To assist our customers where possible if an on-line website Adapt-a-Badge order has not yet reached production stage, we will endeavour to cancel, subject to the following:

Design-a-Badge: To assist our customers where possible if a bespoke Design-a-Badge order has not yet reached production stage, we will endeavour to cancel, subject to the following:
COPYRIGHT. All orders are accepted on the understanding that the customer owns, or has obtained permission to use, all artwork, logos, trademarks and other intellectual property supplied to Tolley Badges Ltd. The customer remains the owner of any intellectual property they provide. Tolley Badges Ltd retains ownership of any original artwork or design elements created independently by our designers unless otherwise agreed in writing. We will not reproduce a customer's bespoke badge for any third party without the original customer's permission.
DISCREPANCIES / FAULTY GOODS. In the very unlikely event of any discrepancies, errors on invoices, or faults on goods, Tolley Badges Ltd must be notified within 48 hours of receipt of invoice/goods. Any queries that are raised after this time will only be reviewed at the Company’s discretion. This does not affect your statutory rights.
To ensure the longevity of your badge and the garment to which it is sewn, badges should be washed at temperatures no higher than 40°c, should not be tumble dried, nor ironed on directly. For heatseal badges, please refer to instructions supplied with your order.
PRICE PROMISE
PAYMENTS
Invoice payments are normally paid by cheque or bank transfer. We can also accept debit/credit card payment by telephone if required.
PayPal payments can also be accepted.
LATE PAYMENTS
If an invoice has not been paid within the agreed time frame (noted on quote and order acknowledgment and invoice); Tolley Badges will chase payments within house. After a period of time your account will then be handed over to debt collectors. Fees and interest charges will be added to your invoice at this stage which the customer will have to pay in full.
INVOICES OUTSIDE OF UK
Orders overseas will be charged TAX and import duty by the country they are delivered to. We do not add the charges onto your invoice from Tolley Badges. Customers to pay these upon delivery of items.
PRIVACY STATEMENT. By using the company website you signify your consent to this Privacy Statement: Do not use this website if you do not agree with all the terms and conditions set out below. Tolley Badges Limited may collect personal information from this site from information submitted, such as your name, gender, mailing address, email address, telephone number and any other information specifically forwarded to us. Any personal data supplied to us may be used to communicate with you regarding new services, products or offers from Tolley Badges Limited, and for record-keeping. Except as expressly stated in this policy we will not sell, share, trade or license any of your personal information to others without your express consent. We reserve the right to disclose your information if requested by the police or any regulatory or government authority in connection with any investigations concerning your activities while visiting the site. We will make all reasonable efforts to protect the security of your information but please be aware that we cannot guarantee the security or transmission of data over the internet.
